Katiba Institute Moves to Court Over Unconstitutional Appointment of Tribunal Members
Katiba Institute has today (22.01.2026) moved to the High Court to challenge the continued defiance by the Executive and the Legislature of the Constitution and binding court decisions on the administration of statutory tribunals.
The Institute is contesting the recent appointment of a member to the National Environment Tribunal by the Cabinet Secretary for Environment, as well as provisions of the Gambling Control Act, 2025, which vest appointment powers over the Gambling Appeals Tribunal in the President and a Cabinet Secretary.
Katiba Institute maintains that both the High Court and the Court of Appeal have been unequivocal that tribunals form part of the Judiciary and that their members can only be appointed by the Judicial Service Commission.
