Appeal on the Constitutional interpretation of Health facilities

This week, Katiba Institute’s Litigation Unit will be at the Court of Appeal for an appeal, to be heard on October 13th 2016 by Judges of Appeal, Waki, Azangalala and Kiage JJA, brought by Okiya Okoiti Omtatah and Wycliffe Gisebe concerns devolution of health. The Appellants unsuccessfully argued at the High Court (Before Lenaola J.) that the Transition Authority unconstitutionally allocated levels 2-5 hospitals to Counties. They argued that those hospitals were owned and functionally intended to be under the National Government.  Katiba Institute had disagreed with the Appellants arguments at the High Court. Katiba Institute will be represented at the Court of Appeal by Conrad Bosire and Waikwa Wanyoike.
