High Court rules that Political Parties must observe 1/3 gender rule in nominations

Justice Chacha Mwita of the Constitutional and Human Rights division of the High Court of Kenya has ruled that Political Parties are bound by the gender requirement in the constitution. In the case that was filed by Katiba Institute, the petitioners sought to have the court declare that any list of nominees for the General Election in 2017 that did not reflect the 1/3 rule was defective. This would mean that the IEBC was bound to decline any lists that fell short. The High Court agreed with the Petitioner’s legal arguments. However, the High Court held that some of the Orders sought would have been destabilizing in this election period. To know more about the case, please read the judgment here.
