High Court Judgment on the unconstitutionality of the Cabinet

In 2015, Marilyn Kamuru, Daisy Jerop and the Centre for Rights Education and Awareness approached the High Court to challenge the constitution of the cabinet. The Petitioners argued that the Cabinet did not adhere to the 1/3 gender rule as women made up less than a third of the cabinet. This was in their opinion a violation of Article 27 of the Cabinet. The questions that the court was asked to consider were:

  1. Is Article 27 applicable in Cabinet appointments?
  2. Does the composition of the Cabinet violate the Constitution?
  3. Was the Right to Dignity violated?
  4. If so, what are the right and proper remedies?
